Use of Site

DomainAuction.US and its affiliates reserve the right to refuse service, terminate relationships, and/or cancel orders in their discretion, including, without limitation, if DomainAuction.US believes that user's conduct violates applicable law or is harmful to the interests of DomainAuction.US and its affiliates.

Email Communication

DomainAuction.US utilizes email as a primary communication channel with customers. As a Customer, and by submitting your information on the DomainAuction.US website, you hereby acknowledge and grant DomainAuction.US the permission to communicate with you via email (as well as other communication channel such as phone and fax) for any purposes DomainAuction.US determines to be relevant including, but not limited to, system messages, product updates, newsletters, service announcements and other marketing messages. DomainAuction.US will use best efforts to honor Customers' requests to opt-out from receiving emails, but under no circumstances will DomainAuction.US have any liability for sending any email to its users and customers.

Payment Terms

Bidder agrees to pay Menius Enterprises, Inc. for any domain name(s) won in auction using the payment method indicated by Menius Enterprises, Inc. Payment of fees shall not be contingent on any events other than having become the successful bidder of the domain name. Any attorney fees, court costs, or other costs incurred by Menius Enterprises, Inc. in collection of delinquent undisputed amounts shall be the responsibility of and paid for by Customer. If payment is not completed within the specified time frame, DomainAuction.US can and will utilize all available legal means at its disposal to collect fees owed by winning bidders. The fees paid to DomainAuction.US, Menius Enterprises, or any of its related companies are non-refundable. All sales are final and unconditional. The Company reserves the right to change its fees or billing methods at any time. The Company will provide timely notice to the affected Customers of any such changes. It is the Customer's responsibility to promptly provide the Company with any contact or billing information changes or updates (including email address, credit card numbers, etc.).

Limitations of Liability

THIS SITE IS PROVIDED BY DOMAINAUCTION.US ON AN "AS IS" BASIS. DOMAINAUCTION.US MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE, ACCESSIBILITY OF THE SITE, OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THIS SITE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DOMAINAUCTION.US DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. DOMAINAUCTION.US WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. Indemnity

You agree to indemnify and hold us and our subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or the materials it incorporates by reference, or your violation of any law, regulation, order or other legal mandate, or the rights of a third party.

Arbitration

Any controversy or claim arising out of or relating to this Agreement or our products or services shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall be conducted in Greensboro, North Carolina, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.

General

This site is created and controlled by Menius Enterprises Inc. in the State of North Carolina, USA. As such, the laws of the State of North Carolina will govern this Agreement, without giving effect to any principles of conflicts of laws. If any provision of the foregoing is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter therein. We reserve the right to make changes to our site, these Terms of Use and this Agreement at any time.

Privacy Policy

DomainAuction.US values customer privacy and will never sell, distribute, or share personal identifying information. All email correspondence with DomainAuction.US is treated as confidential.
